What is Premium Processing?
Premium Processing is an opportunity for people who
are filing certain non-immigrant petitions to have
their petitions processed within 15 calendar days of
the physical receipt of their applications at USCIS.
The program is designed to improve services to
business customers who need to recruit and hire
foreign nationals within short time frames. The fees
generated hopefully benefit all customers by allowing
the USCIS to hire additional personnel and to fund
infrastructure improvements.
Who benefits from Premium Processing?
Certain employment-based classifications within the
form I-129 category may benefit from Premium
Processing These include: E-1, E-2, H-1B, H-2A, H-2B,
H-3, L-1, O-1, O-2, P-1, P-2, P-3 and Q-1 petitions as
well as NAFTA professionals (TN classification).
How much does Premium Processing cost?
The fee of $1,000.00 for Premium Processing fee is over and above 1-129 filing fees already collected by the USCIS.
What are the steps to file for Premium Processing?
The USCIS will consider Premium Processing petitions in the order that they are received. Thus, with regards to those non-immigrant classifications subject to annual numerical limits, such as the H-1B classification, the USCIS will temporarily terminate Premium Processing once this numerical limit is reached, and will return the forms and Premium Processing fee for all requests subject to termination.
If we are preparing a non-immigrant petition for you, we will also prepare the necessary documentation for Premium Processing at no additional charge provided you notify us that you wish to take advantage of this provision prior to our preparing the petition. If a petition is already filed, you may request Premium Processing and we will prepare the documentation for you at an additional cost.
