
Who qualifies for the P-1 classification?
- Internationally-recognized athlete performing at
a specific athletic competition as an individual
athlete or part of a group or team, at an
internationally recognized level of performance.
- Member of an internationally recognized
entertainment group who has had a sustained and
substantial relationship with the group (in most
cases, for one year or more) and provides functions
that are integral to the group's United States
(U.S.) performance.
Non-immigrant Intent
All P classification non-immigrants must have foreign
residences that they do not
intent to abandon. This means they must intend to come
to the U.S. as
temporary nonimmigrants and to depart at the end of
their approved stays under
P classification.
Consultation Required
An advisory opinion must be obtained from an
appropriate labor organization regarding an
individual’s or group's ability, the degree of
international recognition,
and whether the U.S. activities will be appropriate
for an internationally
recognized athlete or entertainment group.
Period of Validity
A P petition for an individual P-1 athlete may be
approved for up to 5 years.
