A non-immigrant is an foreign national who is making
a temporary visit to the U.S. The types of activities
in which the alien can engage while in the U.S. (i.e.,
work, study) depend on the persons non-immigrant
classification. The acquisition of a non-immigrant
visa in some classifications begins with a petition
to the USCIS by a sponsoring employer. Other classifications
do not require this preliminary step. In any case,
the visa itself is obtained through a U.S. consulate
abroad and is stamped in the aliens passport.
A non-immigrant visa only provides permission to appear
at a border and ask USCIS for permission to enter the
U.S. The USCIS determines how long the foreign national
can remain in the U.S. and issues an I-94 with the
date that it expires. Each classification has requirements.
