A petition permanent residence based on being a multinational executive or manager must be submitted to the US Citizenship and Immigration Services from an authorized official of the petitioning United States employer. To qualify, the employer must be doing business in more than one country. That is, the business must have either a parent or a branch in the US and in another country as well. The beneficiary must have been a manager or executive and he/she must have worked for the company overseas for one year of the last three years before coming to the US in order to qualify for this benefit.
The advantage for this type of petition is that no Department of Labor Certification is required. It is a two step process. Verification of the ownership of the two companies is required. Therefore, the permanent resident status may be obtained in less time than a classification that is dependent on Labor Certification.
